The process in Bankruptcy is relatively straightforward. We have provided you with your "HOMEWORK" which requests information that we will use in order to prepare a petition. It is important that you are careful in filling out the forms that we have given you and if you need additonal help we will sit down and go through them with you.
Prior to filing your petition you must complete the first Credit class. We have talked about this in our first meeting. In your bankruptcy folder there is a flier forAccess Counselingor if you prefer in-person Counseling you can contact Credit Counseling Services of Iowa.
Once this information is gathered, we will meet with you to review petition and sign the documents.
After your petition is filed we receive a case number and a date is set for your Meeting of Creditors or 341 Hearing. More information - MOC Q&A
You are now required to complete the second Credit class. You can use the same company you used for the first class.
We meet again to sign any reaffirmations that you might have, discuss what went on at the MOC and answer and questions. More information - Reaffirmations
Lastly, if there are no issues, you will receive a discharge order from the Court about 60-72 days after your meeting of creditors.
